Service Agreement

1. Consent to Terms and Conditions

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Gallapix LLC (hereinafter, "we", "us", or "our"), concerning your access to and use of the businsgh.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all these Terms and Conditions.


2. Ownership of Content and Intellectual Property

Except where expressly indicated otherwise, all elements of the Site, including, without limitation, source code, databases, functionality, software, website design, text, images, graphics, audio, video, and trademarks (collectively, the "Content" and "Marks"), are the exclusive property of the Company or its licensors. These materials are protected by applicable copyright, trademark, and other intellectual property laws, as well as international treaties.

The Content and Marks are provided on an "as is" basis for informational and personal use only. No Content or Marks may be copied, reproduced, distributed, publicly displayed, translated, transmitted, or otherwise exploited for any commercial purpose without the Company's prior written authorization.


3. User Warranties and Representations

By using the Site, you represent and warrant that:

  • All registration information you submit will be true, accurate, current, and complete.
  • You will maintain the accuracy of such information and promptly update such registration information as necessary.
  • You have the legal capacity, and you agree to comply with these Terms and Conditions.
  • You are not under the age of 18 years old.
  • You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise.

4. Acceptable Use Restrictions

You may access and use the Site solely for lawful purposes and in accordance with the functionality intentionally provided by the Company. The Site shall not be used for any commercial purpose unless expressly authorized in writing by the Company.

Users shall not:

  • Systematically extract or compile data or content from the Site without prior written consent;
  • Engage in unauthorized use, including the automated creation of accounts or collection of user information; or
  • Interfere with or attempt to disable the Site's security or technical safeguards.

5. Customer Support

Customer support is available daily between 8:00 AM and 8:00 PM (EST) for troubleshooting, account assistance, and Service-related inquiries. Support methods and response times may vary, and users remain responsible for any internet or equipment costs associated with accessing the Service.

6. Payment Terms

Subscription charges and billing information are communicated during registration and included in your welcome email. Your membership begins immediately at a recurring fee of $39.99 billed every 30 days unless cancelled. By registering for the Service, you authorize recurring subscription payments.

If a recurring payment is unsuccessful, Gallapix LLC may process discounted membership rates to maintain uninterrupted access to the Service. Where discounted payment attempts are also declined, an administrative fee of up to $3.00 may be charged until payment is successfully received.

Users remain responsible for maintaining accurate payment information and for all internet or access-related expenses. Gallapix LLC is not liable for issues involving banks, payment providers, or payment processing systems outside its control. Any payment-related disputes must be resolved directly with the applicable financial institution.

Your Business Insight membership will appear as businsgh.com on your statement.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.


7. Cancellation Rights and Obligations

The Company may, at its sole discretion, suspend or terminate your account and access the Site at any time without prior notice if you violate these Terms or for any other lawful reason.

Subscriptions may be cancelled at any time via your account settings or by contacting support at +1 855 305-1969 or [email protected]. Your access to the Service will remain active until the end of the current billing cycle.


Refunds

Eligible refunds will be processed promptly and credited to the original payment method within fourteen (14) days. Your statutory consumer rights remain unaffected.


8. Warranty Disclaimer and Limitation

The site and services are provided on an "as is" and "as available" basis, and your use of the site is at your own risk. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy, completeness, or reliability of the site content or any third-party websites linked through the site.


9. Limits on Liability

To the maximum extent permitted by applicable law, the Company shall not, under any circumstances, be liable for any indirect, incidental, consequential, exemplary, or punitive damages arising out of or in connection with the use of the Services, whether in contract, tort, or otherwise. The Company's aggregate liability for all claims under this Agreement shall be limited to the total fees actually paid by the User within the twelve (12)-month period immediately preceding the cause of action.


10. Rights and Ownership of User Content

All intellectual property rights, including copyrights, trademarks, and proprietary technologies contained within the Services, shall remain the exclusive property of the Company or its licensors. The User is granted only a limited, non-transferable license to access and use the Services for lawful purposes. No element of the Services may be reproduced, distributed, or exploited without the Company's prior written authorization.


11. Branding and Proprietary Marks

The trade names, branding symbols, service identifiers, and corporate logos of Gallapix LLC are our exclusive marks and are protected by trademark law. No right or permission to utilize any of these marks is granted to you unless explicitly provided in a separate written authorization. Any other trademarks, service marks, or company names displayed on the platform are the property of their respective owners.


12. Force Majeure Clause

Gallapix LLC will not be held responsible or liable for any delay in service, delivery failure, or non-performance resulting from conditions beyond our reasonable management or control. These conditions include, but are not limited to, acts of God, extreme weather events, labor strikes, regulatory action by government bodies, acts of war or terrorism, failures in internet or public utility infrastructure, or any other event categorized as Force Majeure. Our obligations for performance affected by such events will be suspended for the duration of the event plus a reasonable period necessary for recovery.


13. Dispute Resolution and Applicable Law

This Agreement shall be governed by and construed in accordance with the laws of United States of America, without regard to its conflict of law principles. The parties irrevocably submit to the exclusive jurisdiction of the courts located in United States of America for the resolution of any dispute arising out of or in connection with this Agreement.
